House Bill 1333
Amends the Surface Mining Conservation and Reclamation Act
House Bill 1333, authored by State Representative Matt Gabler, amends the Surface Mining Conservation and Reclamation Act (SMCRA) to more closely align Pennsylvania’s standards for temporary ceasing surface mining operations with those enforced under Federal regulations by the Office of Surface Mining Reclamation and Enforcement (OSMRE).
Currently, Pennsylvania regulation limits temporary cessation of surface mining to 180 days except in certain circumstances. This bill would remove the 180-day limitation and replace it with failing to apply for a permit renewal within 180 days of its expiration. The bill requires that all permit obligations must be met during a period of temporary cessation, including any reclamation, backfilling, regrading, vegetation, monitoring and water treatment activities.
